PRESTO Card Terms and Conditions

These terms and conditions govern our relationship with you, the customer. Below is a plain language summary of the important changes to our agreement. This summary is provided as an informational aid only, and does not replace the full Terms and Conditions document.

We may now add more transit agencies on which you can use PRESTO
We clarified the conditions under which we may contact you about your account
We clarified that you must tap your card within 30 days in order for your transaction to be completed
We clarified that each transit agency has specific terms and conditions around the use of their period pass products
We clarified that after you report a card lost or stolen, we require up to 24 hours to deactivate the card
You must notify us within sixty days if you believe that a billing error has occurred on your account
We clarified that replacement cards will be subject to a $6 card issuing fee

This page states the terms and conditions under which you may use PRESTO’s web site pages (the "PRESTO Website"). These terms and conditions relate only to your use of the PRESTO Website and do not govern the use of the PRESTO Card or the PRESTO System. Those activities are governed by the PRESTO Terms and Conditions (as such term is defined below). By accessing the PRESTO Website, you agree to observe and be bound by the following terms and conditions of use. Please read this page carefully. If you do not accept the terms and conditions stated here, do not use the PRESTO Website. You should read this page periodically to review the terms and conditions, as they may be amended from time to time at the sole discretion of PRESTO by updating this posting. Capitalized terms used but not defined herein shall have the meaning given to such terms as set out in the terms and conditions for the PRESTO Card and PRESTO System (the “PRESTO Terms and Conditions”) or the Privacy Policy on the PRESTO Website on which these PRESTO Website terms and conditions appear.

PRESTO Website Accuracy

Although every attempt has been made to ensure the accuracy of all information provided on the PRESTO Website, PRESTO does not make any warranties or representations, express or implied, concerning the accuracy, reliability, currency or completeness of the contents of the PRESTO Website (the "Works") contained in the PRESTO Website. The PRESTO Website is provided on an "as is" basis, without warranty of any kind, and is to be used entirely at your own risk.

Copyright

The Works are protected under the copyright laws of Canada and other countries, as may be applicable. You may view, download, and print contents from the PRESTO Website solely for information purposes and not for commercial use, and as long as the content is not modified in any way. No one may otherwise copy, distribute, republish, or prepare derivative works from any contents of the PRESTO Website without written permission in advance from PRESTO. The use or display of the Works on any other web site for any purpose is expressly prohibited without prior written permission from PRESTO. An acknowledgement of the source must be included whenever PRESTO material is copied or published. Any infringement of PRESTO’s rights will result in appropriate legal action. PRESTO disclaims any and all liability for any consequences that may result from any unauthorized reproduction or use of the Works whatsoever.

Trademarks

Certain names, logos, icons, designs, words, or phrases displayed on the PRESTO Website may constitute trade names or trademarks of PRESTO or other entities, and may be registered in Canada and/or other countries. The display of trademarks on the PRESTO Website does not imply that a licence of any kind has been granted. No one may use any meta tags or any other “hidden text” using PRESTO’s name or trademarks without PRESTO’s express written permission in advance. PRESTO’s name and trademarks may also not be used by anyone in any manner that is likely to cause confusion, or in connection with anything that is not sponsored, endorsed or produced by PRESTO.

The PRESTO Website contains links to other web sites that are created and operated by independent bodies and are therefore, not under the control of PRESTO. References may also be made to web sites, products, services or publications of third parties. As such web sites, parties, products, services and publications are independent from PRESTO and PRESTO has no control over them, PRESTO is not responsible for them, their content or your use of the same. Any links or references are provided for your convenience, and are not to be taken to mean that PRESTO endorses or approves of such web sites, parties, products, services or publications.

Privacy

All reasonable steps have been taken to ensure the security of your personal information transmitted over the internet; however, the internet is not a secure medium, and neither the privacy of your communications, nor visits to the PRESTO Website, can be guaranteed. The nature of internet communications means that your communications may be susceptible to data corruption, unauthorized access, interception and delays. Please do not send personal or confidential information to us by regular, unencrypted E-mail messages over the internet, as the internet provides no assurance that such messages will remain private. PRESTO provides a secure, confidential channel for you to provide and view such information in its web-based applications for services. PRESTO will therefore not be responsible or liable if you send personal or confidential information to PRESTO over the internet using regular, unencrypted E-mail messages, or if PRESTO sends you information in that manner at your request, if any such information subsequently becomes public through no fault of PRESTO. PRESTO will collect, use and disclose your personal information in accordance with the terms of the PRESTO Privacy Policy.

Agreements

The services described in the PRESTO Website which are available from PRESTO are subject to the terms and conditions of agreements specific to those services including, but not limited to, the PRESTO Terms and Conditions, and are available only where offered by PRESTO and permitted by law.

Exclusion of Liability

You agree to have sole responsibility for adequate protection and backup of data and/or equipment used in connection with the PRESTO Website. In connection with your viewing and use of the PRESTO Website, PRESTO shall not be liable for any damages, harm, liability, loss, cost, expense, or injury suffered in any way in connection with the PRESTO Website whatsoever including without limitation, as a result of viewing, using, accessing, copying, downloading or storing any part of the Works. In no event shall PRESTO be liable for any direct, indirect, special, incidental, third-party, punitive, exemplary or consequential damages (including loss of business, revenue, profits, use, data or other economic advantage) however same may arise, whether for breach of contract, in tort, negligence, equity, or otherwise, even if PRESTO has been previously advised of the possibility of such damage, and you will not seek any equitable relief whatsoever.

Applicable Law

By entering the PRESTO Website you acknowledge and agree that the PRESTO Website will be construed and evaluated according to the laws of the Province of Ontario, Canada. You hereby agree and confirm that your use of the PRESTO Website and all of the communications, transmissions and transactions associated with the PRESTO Website shall have occurred in the Province of Ontario, Canada and that you submit to the exclusive jurisdiction of the courts of the Province of Ontario as the proper and most convenient forum concerning the PRESTO Website. If you use the PRESTO Website from another jurisdiction, you are responsible for compliance with any and all applicable local laws. PRESTO makes no representation that the materials contained within the PRESTO Website are appropriate for customers outside of the Province of Ontario, Canada.
